We are the data controller for personal information collected through our website, direct email enquiries, and purchases of products and services from us.

This Privacy Policy explains how we collect, use, store, share and protect personal information in accordance with applicable UK data protection legislation.

It applies to all products and services provided by The Conscious Parent Company, including Hair Tissue Mineral Analysis (HTMA).

2) What we collect

A) General enquiries and purchases

When you contact us or purchase products or services through our website or directly by email, we may collect:

• Your name, billing and delivery address, email address and telephone number.
• Details of products or services purchased.
• Order confirmations, payment status and transaction references.
• Delivery and fulfilment information, where applicable.
• Correspondence relating to enquiries, orders and customer support.

Payments are processed through our authorised payment providers, including Stripe where applicable. We do not receive or store your full payment card details.

B) Hair Tissue Mineral Analysis (HTMA) orders

For HTMA orders, we may also collect:

• The name and contact details of the person arranging the test.
• The name or identifying details of the person being tested, where necessary.
• Confirmation of parental or legal guardian authority where testing is arranged for a child.
• Details of the test purchased, including optional additional elements.
• Records of consent relating to the handling of laboratory reports.
• Relevant correspondence concerning the test and delivery of results.

We do not ordinarily collect completed laboratory health questionnaires or physically handle hair samples. Customers submit these directly to Mineral Check Ltd according to the testing instructions.

We receive completed HTMA laboratory reports from Mineral Check Ltd so that we can securely deliver them to the authorised recipient.

These reports contain personal information, including health-related data, which is given additional protection under data protection legislation.

C) Direct email orders

Some orders, including international HTMA orders, may be arranged directly by email rather than through our website checkout.

In these circumstances, we collect the information necessary to arrange the purchase, confirm payment, provide testing documentation and fulfil the order.

Where explicit consent is required for the handling of HTMA reports, this is requested separately and recorded through the email ordering process.

D) Information received from other sources

We may receive information from payment providers, delivery companies and other service providers where necessary to manage orders.

For HTMA testing, we receive completed laboratory reports from Mineral Check Ltd, our UK laboratory partner.

3) Why we process your data (lawful bases)

We process personal information only where we have an appropriate lawful basis under the UK General Data Protection Regulation (UK GDPR).

Processing and fulfilling orders

We use order and contact details to process purchases, arrange delivery and provide the products or services requested.

Responding to enquiries

We use contact details and relevant correspondence to answer questions about our products and services.

We use contact details to provide payment confirmations, delivery updates, testing instructions, report notifications and other communications necessary to fulfil an order.

Receiving and delivering HTMA reports

We receive and securely deliver laboratory reports containing health-related information.

Lawful basis: Contract, Article 6(1)(b), together with explicit consent under Article 9(2)(a) for the processing of special category health data.

Explicit consent is requested separately through the website checkout process or by email for orders arranged directly with us.

Where testing is arranged for a child, we request confirmation of appropriate parental or legal authority and address the applicable consent requirements.

Consent may be withdrawn at any time by emailing privacy@theconsciousparent.co.uk.

Withdrawal does not affect processing already carried out lawfully, but it may prevent us from receiving or delivering the laboratory report.

Accounting and legal obligations

We retain relevant financial and transaction records for accounting, taxation and other legal requirements.

Customer support

We use relevant information to respond to questions, resolve problems and maintain appropriate records of customer communications.

Marketing communications

4) Who we share data with

Depending on the product or service purchased, this may include:

• Mineral Check Ltd (UK), our HTMA testing partner.
• Microsoft 365, OneDrive and Exchange Online, used for business communications, secure file storage and document delivery.
• Payment providers, including Stripe where applicable.
• Website hosting and technical service providers, where necessary to operate our website.
• Professional advisers or relevant authorities where disclosure is legally required or otherwise justified.

We do not sell your personal information.

HTMA laboratory processing

The Conscious Parent works with Mineral Check Ltd, the UK distributor for Trace Elements Inc., based in the United States.

HTMA testing instructions and documentation may be supplied electronically or, where applicable, through a physical collection kit.

Customers submit their hair samples and required laboratory documentation directly to Mineral Check Ltd in the UK.

Mineral Check coordinates laboratory analysis through Trace Elements Inc., which produces the laboratory report.

The completed report is returned to Mineral Check Ltd, which then supplies it to The Conscious Parent for secure delivery to the authorised customer.

The Conscious Parent does not directly send hair samples or completed laboratory health questionnaires to Trace Elements Inc.

5) International transfers

Some personal information associated with HTMA testing is processed outside the United Kingdom.

Mineral Check Ltd arranges the transfer of hair samples and associated laboratory information to Trace Elements Inc. in the United States for analysis.

The completed laboratory report is subsequently returned through Mineral Check Ltd to The Conscious Parent in the UK.

Mineral Check is responsible for arranging the laboratory transfer and the applicable data protection requirements relating to that transfer.

Some technology and payment service providers may also process or access personal information outside the UK.

International transfers of personal information must comply with applicable UK data protection requirements, including the use of recognised adequacy arrangements or appropriate safeguards where required.

6) How long we keep data

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy, subject to applicable legal requirements.

HTMA laboratory reports and related health information

Retained for 12 months, then deleted in accordance with our retention procedures.

Order and invoicing records

Retained for up to 7 years in accordance with our accounting and record-keeping policy.

General customer support and enquiry emails

Retained for up to 12 months, unless a longer period is necessary for an ongoing matter or legal requirement.

Marketing consent records

Retained for as long as necessary to manage marketing preferences and demonstrate compliance. Limited information may be retained after withdrawal to ensure that an unsubscribe request continues to be respected.

Where accounting records must be retained for longer than HTMA laboratory reports, we retain the necessary financial and transaction information separately from the laboratory results.

7) Security

We take appropriate technical and organisational measures to protect the personal information we hold.

These include:

• Microsoft 365 security protections, including encryption in transit and at rest.
• Multi-factor authentication.
• Restricted access to sensitive personal information.
• Secure storage and controlled access to laboratory reports.
• Password-protected or restricted-access links for the delivery of sensitive documents where appropriate.
• Internal record-keeping and deletion procedures.

Access to HTMA laboratory reports is restricted to authorised individuals who require the information to manage and deliver the service.

We take reasonable steps to protect personal information against unauthorised access, loss, misuse or disclosure.

8) Your rights

Under applicable UK data protection legislation, you have rights relating to your personal information, subject to relevant conditions and exemptions.

These may include:

• The right to access personal information we hold about you.
